WEB FONT SOFTWARE END USER LICENSE AGREEMENT

This Web Font Software End User License Agreement ("License" or "Agreement") is a legal agreement between you or the company, organization, or other legal entity that you represent ("the Licensee") and Unwritten Type Foundry ("the Licensor"). By obtaining, downloading, and/or installing the delivered software, you agree to the terms and conditions set forth in this Agreement. This is the governing agreement for all Web fonts by Unwritten Type Foundry unless an explicit custom license is provided within the purchased font package.

1. TERMS AND DEFINITIONS

1.1 "Web Font Software" (hereinafter "Web Font"): Any digital font software provided in web-optimized formats (e.g., WOFF, WOFF2).

1.2 "Web Server": A computer system or cloud server hosting web files to serve requested HTML pages or digital assets to client browsers.

1.3 "Basic Web Font License": A license that grants the Licensee the set of non-exclusive rights explicitly listed in this Agreement.

1.4 "Additional License": An extension or custom license purchased separately that confers additional rights, including higher pageview tiers, multi-domain usage, web/mobile app embedding, SaaS integration, or website template bundling.

1.5 "Licensee": The individual, company, organization, or agency purchasing the license or to whom the license is issued.

1.6 "Licensor": Unwritten Type Foundry.

1.7 "Unwritten Type Foundry": Alfredo Marco Pradil, operating as an autónomo (self-employed professional) under Spanish law with NIE Z3622680R, doing business under the commercial name Unwritten Type Foundry, based in Zaragoza, Spain.

2. GRANT OF LICENSE AND RESTRICTIONS

2.1 Non-Exclusivity: This Basic Web Font License grants the Licensee a limited, non-exclusive, non-transferable, and perpetual right to self-host and render the Web Font Software strictly as set forth in this Agreement.

2.2 Permitted Web Usage & Pageview Tiers: The Licensee is granted the right to embed and render the Web Font via @font-face CSS rules for both commercial and non-commercial purposes on one (1) primary website domain owned or controlled by the Licensee.

The Basic Web Font License covers up to 10,000 monthly pageviews. Exceeding this traffic volume requires an upgraded license tier, calculated using the following base multipliers:

  • Up to 25,000 monthly pageviews: Base License Price × 2.5
  • Up to 100,000 monthly pageviews: Base License Price × 5.0
  • Up to 250,000 monthly pageviews: Base License Price × 10.0
  • Up to 500,000 monthly pageviews: Base License Price × 15.0
  • Up to 1,000,000 monthly pageviews: Base License Price × 20.0

For traffic exceeding 1,000,000 monthly pageviews, multi-domain networks, or enterprise usage, contact unwrittentype@gmail.com.

Exclusions: This license explicitly excludes:

  • Desktop installation on Workstations to create static print or digital artwork.
  • Embedding or bundling within mobile applications, native desktop software, games, or commercial website templates.
  • Live text customization tools, dynamic SVG/Canvas font engines, or user-editable web applications.

2.3 Web Server Security: The Licensee must self-host the Web Font on secure Web Servers owned or leased by the Licensee and implement reasonable security measures (such as CORS header domain-locking) to prevent cross-domain hotlinking or unauthorized file extraction.

2.4 Backup Copying: The Licensee is permitted to create one (1) backup copy of the Web Font Software solely for archival and security purposes. This copy must remain under the exclusive control of the Licensee and cannot be shared or distributed.

2.5 Non-Transfer to Third Parties: The Licensee may not sell, give, rent, lease, sublicense, assign, or make the Web Font available to third parties under any circumstances.

2.6 Distribution: The Licensee may not distribute, host, or publish the Web Font Software in a commercial or non-commercial manner, standalone or bundled with third-party software or hardware.

2.7 Modifications: The Licensee may not modify, adapt, alter, rename, translate, reverse engineer, decompile, disassemble, subset, or attempt to discover the source code of the Web Font Software. Any customized derivative versions created remain the exclusive intellectual property of the Licensor.

3. TERMINATION

This Agreement is effective perpetually unless terminated due to a breach. This Agreement will terminate automatically without notice if the Licensee fails to comply with any provision contained herein. Upon termination, the Licensee must immediately remove the Web Font Software from all Web Servers, cease all website rendering, and destroy all original and backup copies in their possession.

4. NO WARRANTY

The Web Font Software is provided "AS IS", without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Licensor does not warrant that the software will be error-free or render identically across all browser environments.

5. INTELLECTUAL PROPERTY

The Licensee acknowledges that Unwritten Type Foundry owns all intellectual property rights, trademarks, copyrights, title, and interest in and to the Web Font Software. The Web Font Software is protected under Spanish Intellectual Property Law (Ley de Propiedad Intelectual), European Union directives, and international copyright treaties.

6. LIMITATION OF LIABILITY

THE LICENSOR DISCLAIMS ALL LIABILITY FOR ANY INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR COMPUTER MALFUNCTION, ARISING OUT OF THE USE OR INABILITY TO USE THE WEB FONT SOFTWARE. IN NO EVENT SHALL THE LICENSOR'S TOTAL CUMULATIVE LIABILITY EXCEED THE EXACT AMOUNT PAID BY THE LICENSEE TO ACQUIRE THIS LICENSE.

7. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by, construed, and enforced in accordance with the laws of Spain. Any disputes, claims, or legal actions arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Zaragoza, Spain.
